By using our App, you acknowledge that you have read, understand, and agree to be bound by these Terms. You also acknowledge that the App is a research tool not intended for medical use and that you will not use it for such purposes.

Introduction

Welcome to VRIF. This App is designed as a tool for research and is not intended for medical use. By accessing and using our App, you, the user, agree to these Terms and Conditions.

  1. Acceptance of Terms

1.1 By using our App, you signify your acceptance of these Terms. If you do not agree to these Terms, you are not allowed to use the App.

1.2 These Terms may be amended or updated by us from time to time without notice and the Terms may have changed since your last visit to the App. It is your responsibility to review these Terms for any changes. Your use after any amendments or updates of these Terms shall signify your assent to and acceptance of such revised Terms. Any new features that may be added to the App from time to time will be subject to these Terms, unless stated otherwise.

  1. Medical Disclaimer and Limitation of Use

2.1 Nature of the App: VRIF is a research tool intended for informational and educational purposes only. It is not designed or intended for use in the diagnosis, prevention, treatment, or management of any health condition or disease. The App is not a substitute for professional medical advice, diagnosis, or treatment.

2.2 No Clinical Reliance: Users should not rely on this App for any medical or healthcare decision-making. The information provided by the App is not comprehensive and does not cover all diseases, ailments, physical conditions, or their treatment. Always seek the advice of a qualified healthcare professional for medical concerns.

2.3 Accuracy of Information: While we strive to provide accurate and up-to-date information, we do not guarantee that the information contained in or made available through the App is accurate, complete, reliable, current, or error-free. The App is provided “as is” and “as available.”

2.4 Limitations of Content: The content of this App is not intended to be a substitute for professional medical advice. Any content, tools, or resources provided through the App are for general informational purposes only.

2.5 User Discretion: Users must exercise their own discretion in using the App and evaluating the information obtained from the App. Users are solely responsible for any actions or decisions made based on the use or interpretation of information provided by the App.

2.6 Limitation of Liability: To the fullest extent permitted by law, VRIF expressly disclaims all liability in respect of any harm, injury, illness, or any other negative outcome that arises from or is related to the use of the App or reliance on its content.

2.7 Indemnification: You agree to indemnify, defend, and hold harmlessVRIF and its affiliates, officers, agents, employees, and partners from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.

2.8 No Endorsements: The App may contain references to specific products, services, or healthcare providers, but such references are not endorsements or recommendations by VRIF. We do not endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned in the App.

2.9 Changes to Medical Disclaimer: We reserve the right to modify or amend this disclaimer at any time. Your continued use of the App after any changes signifies your acceptance of the updated disclaimer.

  1. No Doctor-Patient Relationship

3.1 Absence of Professional Relationship: By using VRIF, you understand and expressly agree that there is no doctor-patient relationship or any other healthcare provider-patient relationship between you and the App, VRIF, and any of its affiliates or employees.

3.2 Not a Medical Service: The App does not provide medical services, emergency services, or any healthcare services of any kind. It should not be used for seeking, and does not provide, any form of medical diagnosis, treatment, or care.

3.3 No Substitute for Professional Judgment: The information and services provided by the App should not be considered as a substitute for the individualized, professional judgment of a healthcare provider. All decisions regarding patient care must be made with a healthcare provider, considering the unique characteristics of each patient.

3.4 User Responsibility: As a user, you acknowledge that your reliance on any information provided by the App is solely at your own risk. It is your responsibility to evaluate and confirm the information obtained from the App with other sources, and to seek the advice of a qualified healthcare professional regarding any medical condition or treatment options.

3.5 No Endorsement of Users: The App may enable user interactions, including but not limited to, forums, chats, or message boards. Any statements made by users are those of the users alone, and do not represent the views or endorsements of VRIF. Reliance on any information provided by other users of the App is solely at your own risk.

3.6 Confidentiality Limitations: While we strive to protect the confidentiality and privacy of our users, communications via the App may not be confidential. Users should be cautious about sharing any personal health information within public areas of the App.

3.7 Consultation Encouragement: We encourage users to consult with a qualified healthcare provider for diagnosis and for answers to personal health questions. The App is not designed to facilitate direct communication between healthcare professionals and patients.

3.8 Emergency Situations: In case of a health emergency, users should contact emergency services immediately. The App is not designed or intended to be used in any emergency or urgent situations.

  1. Limitation of Liability

4.1 General Limitation: To the fullest extent permitted by law, VRIF and its affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for any direct, indirect, incidental, special, consequential, punitive damages, or damages for loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to, or use of, the App or any services provided through the App.

4.2 Content Limitations: We are not liable for any content posted, transmitted, exchanged, or received by or on behalf of any user or other person on or through the App. This includes any user content that may be lost, corrupted, or damaged.

4.3 No Liability for Unavailability: VRIF shall not be liable if the App or any services are unavailable at any time or for any period. Access to the App may be suspended temporarily and without notice in the case of system failure, maintenance or repair, or for reasons beyond our control.

4.4 No Liability for Third-Party Links: The App may contain links to third-party websites or resources. VRIF has no control over the content of those sites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

4.5 Limitation on Claims: Any claims arising in connection with your use of the App or any content must be brought within one (1) year of the date of the event giving rise to such action. If not, such claims or causes of action are permanently barred.

  1. User Responsibilities

5.1 Compliance with Terms: As a user, you are responsible for your own conduct and for complying with all applicable laws, regulations, and these Terms. You must not use the App or its content for any illegal or unauthorized purpose.

5.2 Accuracy of Information Provided: You are responsible for ensuring that any information you provide to the App is accurate, current, and complete. You agree to update your information as necessary to maintain its accuracy.

5.3 Responsible Use of the App: You agree not to misuse the App or help anyone else do so. This includes, but is not limited to, doing anything that could disable, overburden, or impair the proper working or appearance of the App, such as a denial-of-service attack or interference with page rendering or other App functionality.

5.4 Content You Provide: You are solely responsible for the content you provide via the App, including its legality, reliability, and appropriateness. By posting content, you grant VRIF the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the App.

5.5 Security of Your Account: You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer, network, and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

5.6 Reporting Misuse: If you become aware of any misuse of the App or any secu=rity breach in connection with your account, you must immediately report it to vrifmed@gmail.com.

5.7 Information Gained: All information gained from this tool and used for any purpose is strictly the user’s responsibility.

6.1 Privacy Policy Agreement: Your use of the App is subject to our Privacy Policy. By accepting these Terms, you also agree to our Privacy Policy, which is incorporated herein by reference.

6.2 Data Collection: We collect information you provide directly to us, such as when you create an account, update your profile, access our content, make a purchase, request customer support, or otherwise communicate with us. This information may include, but is not limited to, your name, email address, phone number, and any other information you choose to provide.

6.3 Usage Data: We also automatically collect information about your interactions with our App, such as the pages or other content you view, your searches for products or services, and other actions on the App.

6.4 Cookies and Tracking Technologies: We use various technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help us improve our App and your experience, see which areas and features of our App are popular, and count visits.

6.5 Use of Information: We may use the information we collect to:

  • Provide, maintain, and improve our App;
  • Respond to your comments, questions, and requests, and provide customer service;
  • Communicate with you about products, services, offers, and events offered by us and others, and provide news and information we think will be of interest to you;

  • Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of the Company and others.

6.7 Security: We take reasonable measures to help protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction.

6.8 International Transfer: Your information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

6.9 Your Choices: Account information you provide may be updated, corrected, or deleted by logging into your account or emailing vrifmed@gmail.com. You may opt-out of receiving promotional emails from us by following the instructions in those emails.

6.10 Changes to the Privacy Policy: We may update our Privacy Policy from time to time. If we make material changes to how we treat our users’ personal information, we will notify you through the App or by other means.

6.11 Medical Images: CT scans shared on our platform are not stored after processing, it is just used to make a de-identified model, and then the files are subsequently destoryed.

7.1 Right to Modify Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It is your responsibility to regularly review these Terms to stay informed of updates.

7.2 Notification of Changes: Any changes to these Terms will be communicated through the App, or via email, or other communication means used by the App. The date of the last update will be indicated at the top of the Terms.

7.3 Acceptance of Changes: Your continued use of the App after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new terms, you are no longer authorized to use the App.

7.4 Archival of Previous Terms: Previous versions of these Terms will be archived and available upon request. It is your responsibility to be aware of any changes.

  1. Governing Law and Jurisdiction

8.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of The United States of America, without giving effect to any principles of conflicts of law.

8.2 Jurisdiction: You agree that any judicial proceeding relating to or arising out of these Terms or your use of the App will be instituted only in a federal or state court of competent jurisdiction in The United States of Virginia. You consent to the exclusive jurisdiction of such courts for any such proceedings.

8.3 Compliance with Local Laws: The App is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

8.4 Dispute Resolution: Before filing a claim against VRIF, you agree to try to resolve the dispute informally by contacting us at vrifmed@gmail.com. We’ll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 180 days of submission, formal proceedings may be initiated.
